1. Disclaimers and liability

As the law lends nuance to be observed from country to country, the following terms will be able to be applied to the respective countries of our users

1.1.  Use of our website may contain forwarding links to other websites. You, therefore, agree that as we have no control over said websites, we shall not be held any responsible for any harm or loss that may result from those visits. You accept that you knowingly use those websites at your own risk.

1.2. You are reminded that certain aspects of our website may include technical errors or inaccuracies.  We will endeavour to correct any errors as quickly as we can and would appreciate being notified if they are found by our users.

1.3. All conditions, guarantees and warranties are exempt from this agreement and are agreed upon, separately. If, in the event that this is not possible in certain countries, then this subclause can be bypassed or mitigated in order to accommodate the release of that condition or warranty for the user/customer.

1.4. This agreement of one’s liability also applies to you as the user. You, therefore, will agree to:

• Not to submit any false or misleading detail of any kind.
• Assume the identity of other users through copying, imitating or redistributing their personal content without their express permission.
• Not to gather or otherwise collect information about our users, such as email addresses and personal details, without their consent

2. Intellectual Property& External Private Networks

You will agree not to copy, imitate or distribute rights or content of Esukk including certain intellectual property, such as our copyrights and trademarks. In addition, you agree:
2.1.Not to do anything that will adversely affect the value of our intellectual properties or challenge our ownership of it.
2.2.  That as far as the services that we provide and access to you is concerned, you will not:

• Replicate or manipulate any part of its code.
• Utilise it in a manner which we would consider a violation of our agreement.
• Share its code and/or give access to any other person than yourself.
• Use our intellectual property in a manner considered outside the scope of our agreement.

2.3. To alert us to any violation(s) or suspected infringement(s) of our intellectual property.

2.4. Use tools such as VPNs to bypass measures that have been put in place to limit use of Esukk to eligible countries. Such use of VPN’s is strictly unauthorised and can bring about further action.

2.5.Not to introduce malware such as viruses and trojans that may contribute to the damage and disruption of the operation of Esukk and its services.

3. Age-appropriate Use of Esukk

The user must be of appropriate age to access to buy or acquire our products and services. Appropriate age, in this context, will refer to the age at which one is considered an adult in their respective countries. In any case, for the protection of all users, our policy is as follows:

3.1. We do not knowingly collect personal information from any person under the age of 18 years.

3.2.  It is you, not we, who provide access to Esukk for the children in your care. It is for you to check that the Content your children might see is suitable for them.

3.3. Parents of underage children will be responsible for their personal information being shared with us.

3.4. Any person of any age may freely access any page of Esukk. We do not check identities nor moderate Content. The restriction, regarding ‘appropriate age’, will only apply to payment.

3.5. Where links and third-party sites are concerned, you may like to check their policies, regarding privacy, where your children might visit frequently to see how they collect, harvest and use information.

3.6. You acknowledge that we are not responsible for the information and content that anyone has placed on Esukk.

3.7. You also agree to waive any claim you may otherwise have against Esukk relating to age-related suitability and to relieve us of any future claims made on behalf of a child in your care.

4. Miscellaneous

4.1.  If any clause or provision of this contract is at any point in timeheld by acountry to be voidor unenforceable, then it shall be treated as such up until a time at which it can be amended and kept in accordance with the regulations of the nation, concerned. With that in consideration, every clause in our Terms of Use will carry the threat of beings severable but will remain in force until communicated otherwise.

4.2.  Any failure or delay by either party to exercise any right, power or  solution will notact as a waiver nor indicate any intention to reduce that or any other right in the future.

4.3.  Any communication to the user/customer will be delivered by first class post or by e-mail. If delivered by mail, within 72 hours of the transaction. If sent by e-mail to the address from which the receiving party has last sent e-mail, however: within 24 hours if no notice of non-receipt has been received by the sender.

4.4.  The creation, validity and implementation of this agreement will be governed and upheld by the laws of England and Wales, and you agree that any legal disputes shall be only litigated in that country.

5. Our Products & Services

Certain products and/or services, offered by Esukk, may be only available online, through our website. We have made every effort to ensure that our goods are displayed as accurately as possible, and that our images and varieties of certain products match its physical appearance. We will not be held responsible for any technical complications (monitor display, brightness of monitor etc.) that may result in any apparent inaccuracies.

Esukk will retain the right, but will not be obligated, to restrict the sales of our products to any individual, country or jurisdiction. Such discretionary measures will be taken on a case-by-case basis and will be communicated to the user concerned, as and when it is possible to do so. Moreover, we also reserve the right to restrict the quantities of any products of services that we offer.

Any description or pricing of products can be altered or amended at our discretion at any time, without notice. Conversely, we also retain the right to terminate and stop the production of a product at any time. Any offers for said products and services will be made void in the event of it being illegal or prohibited.

6. Fees & Billing

Purchases on Esukk’s website will be accepted in British Sterling and the American Dollar. We may, at our discretion, restrict or void orders where quantities are purchased per person, household or order. These restrictions include but are not limited to; orders placed under the same user account; the same debit/credit card; and or the same billing/shipping address. We will always endeavour to notify the customer by email, phone or mail as quickly as we can so as to provide ample time to correct, change or cancel their order. Esukk retains the right to restrict or cancel orders that we believe to have been made by third-party dealers, resellers or distributors.

You will therefore agree to ensure that your details are up to date, and that you can provide accurate purchase information for all purchases made with Esukk. You will agree to promptly update your information should there be any changes, such as a new address, contact number or billing information. This will ensure that we will be able to correct or remedy any issues without delay.

7. Our Responsibilities

Nothing in these terms shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from Esukk’s alleged negligence or the alleged negligence of our agents or employees. You agree that we will not be held responsible for things that may result outside of our services.

Under no circumstances do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, or false information; including but not limited to any material of any kind which violates or infringes upon the rights of any other person. The offences that have been referred to are considered as acts that encourage conduct that would bring about criminal charges and violate a number of applicable laws in the country where the offence has taken place.

Moreover - to the extent, legally accepted in certain countries - we unequivocally reject all warranties, representations and condition - express or otherwise - of goods pertaining toits physical quality, marketable quality,fitness for a particular purpose and those upheld by law. We will not be held liable for any lossof finances, goodwill, or any special, indirect, or consequential damages resulting from your use of Esukk. There are countries that do not allow disclaimers of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

8. Terms of Agreement

These Terms of Use outlined, constitute the entire agreement between Esukkand you, and supersedes any prior agreements. The Terms of Use shall be governed and upheld in all respects by the laws of England and Wales. You agree that any disputes you may have against Esukkand any resultant legal proceedings must be resolved by the courts of England and Wales.

With the exception of notices relating to illegal or infringing content, your notices to must be sent by email to us. We will send notices to you via the email address you provide.

This agreement may be updated at any given time, with updates taking effect when you next visit our website or 14 days after we post the updated policy on ourwebsite. Unless it has been put in writing, no other amendment to this agreement will be brought into effect. It will also need to be signed by the user and by us.

Any material changes that affect your rights will require your agreement to continue to use our services and you will also be notified of your right to reject these changes and its implications. However, in regard to non-material changes - such as changes to our services or changes that are required by law and/or a legal authority, your continued use of Esukk after our changes will be considered as acceptance of our revised terms until the next instance where our Terms of Use are updated.
